This Privacy Policy applies to the Elder Resource Association website at https://www.erasouth.org (the “Website”). This Privacy Policy also applies to information you voluntarily provide to us. This website was not created to serve, nor does it actively market to residents outside of the State of Minnesota.

When accessing our website, ERA will learn certain information about you during your visit. This Privacy Policy describes how we collect, use, share and protect information you provide to us.  If you do not agree with the terms of our Privacy Policy, you should immediately stop using or visiting this Website.

This Privacy Policy provides you with details of how we collect and process non-personally identifiable information and personally identifiable information (“PII”). Non-personally identifiable information includes information that cannot be used to personally identify you, such as the type of browser you are using, the type of operating system you are using, the domain name of your internet service provider, your Internet Protocol (IP) address, your geographic location, etc. The type of information that constitutes PII is provided in Section 2 below.

  1. WHAT DATA DO WE COLLECT ABOUT YOU?

You may provide personal data to us for various purposes. Personal data is any information capable of identifying a particular individual. It does not include anonymized data. By providing us with your personal data, you warrant to us that you are at least 18 years of age. Personal data includes:

  • Financial Data may include your bank account and payment card details.
  • Transaction Data may include details about payments between us and other details of purchases made by you.
  • Technical Data may include your login data, internet protocol addresses, browser type and version, browser plug-in types and versions, time zone setting and location, operating system and platform and other technology on the devices you use to access this site.
  • Profile Data may include your username and password, purchases or orders, your interests, preferences, feedback and survey responses.
  • Usage Data may include information about how you use our website, products and services.
  • Marketing and Communications Data may include your preferences in receiving marketing communications from us and our third parties and your communication preferences.

We may also process aggregated data from your personal data but this data does not reveal your identity and as such in itself is not personal data. An example of this is where we review your usage data to work out the percentage of website users using a specific feature of our site. If we link the aggregated data with your personal data so that you can be identified from it, then it is treated as personal data. Aggregated data related to visitors to and users of this Website may be shared with affiliated or unaffiliated third parties.

Sensitive Data

We do not collect any sensitive data about you. Sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. We do not collect any information about criminal convictions and offenses.

    • attend an ERA sponsored meeting;
    • purchase vendor space at an ERA events;
    • subscribe to our service or publications

    • enter a competition, giveaway, promotion or survey

  • Automated technologies or interactions: As you use our Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and usage patterns, including details of your visits to our Website, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Website, and information about your computer and internet connection, including your IP address, operating system and browser type. We collect this data by using cookies, server logs and similar technologies. We may also receive technical data about you if you visit other websites that use our cookies.     • Social Media platforms such as Facebook, Instagram, Twitter, Pinterest, LinkedIn, YouTube, Google + [Additional Social Media]
    • Analytics providers such as Google.
    • Advertising networks such as Adsense and Amazon ads; and
    • Contact, financial and transaction data from providers of technical, payment and delivery services such as PayPal, etc.
  1. HOW WE USE YOUR INFORMATION

We use your information to operate, maintain and provide to you the features and functionalities of this Website, including for the purposes for which you provided such information to us and to process and respond to your inquiries, to complete a transaction, to contact you, to update you on ERA news and events, to administer and troubleshoot the Website and as otherwise provided in this Privacy Policy as permitted or required by law.                                                                                                                                          

Generally, we do not rely on consent as a legal ground for processing your personal data, other than in relation to sending marketing communications to you via email or text message. You have the right to withdraw consent to marketing at any time by clicking unsubscribe at the bottom of any email or by emailing us at info@erasouth.org.

ERA does not sell, rent, lease or otherwise share your name, phone number, physical address or email address with third parties except as otherwise provided in our Privacy Policy. Data is collected via MembershipWorks for the purposes of the ERA website.

We may use third parties in connection with this Website and its operations. We may share information about you with these third parties, or allow these third parties to collect information about you on our behalf, that they may need to perform their functions and in accordance with our agreements with them.

If we become involved in a merger, acquisition, joint venture, bankruptcy, reorganization, dissolution, conversion or some other transaction, we may share or transfer your information to a third party or parties in connection therewith.

We may disclose information about you to third parties to comply with the law, in responses to subpoenas, warrants, or court order or in connection with any legal process or to cooperate with government or law enforcement officials or private parties to the extent permitted or required by law; to protect our rights, reputation, safety and property, or that of the other users of this Website or other; to protect against potential liability; to establish or exercise our rights to defend against legal claims; or to investigate, prevent or take action with respect to suspected illegal activities, suspected fraud, the rights, reputation, safety or property of us, our users or others, violation of our policies or agreements or as otherwise permitted by law.

Marketing communications

You may receive marketing communications from us if you have:

  1. requested information from us, created an account, applied for membership or purchased vendor space from us for an event; or
  2. if you provided us with your personal information and give us consent to send you marketing communications; and
  3. in each case, you have not opted out of receiving such marketing communications.

You can ask us to stop sending you marketing messages at any time by contacting us at info@erasouth.org.

Opting out of receiving our marketing communications will not apply to personal data provided to us as a result of a purchase, experience at one of our events or other transactions with us.

  1. DATA SECURITY

We have put in place appropriate security measures, including physical, technical and administrative procedures, to safeguard and secure your personal data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed.  Unfortunately, the transmission of information over the internet is not completely secure or error free. Emails sent to or from this Website may not be secure. You should use caution whenever submitting information and take special care in deciding what information you send to us via email. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

  1. DATA RETENTION

We will retain your personal data for the length of time necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. We will also retain and use your information for as long as necessary to resolve disputes and/or enforce our rights and agreements.

By law we may have to keep basic information about you (including Contact, Identity, Financial and Transaction Data) for 7 years after you cease being a customer for tax purposes.

In some circumstances we may anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

Under certain circumstances, you may have rights under data protection laws in relation to your personal data. We offer you the ability to control and manage the personal data we have about you. For personal data that we have about you, you can:

  • Request access to your personal data.
  • Request correction of or an update to your personal data, particularly if it is inaccurate.
  • Request ERA of your personal data (e.g., if it is no longer necessary to provide services to you).
  • Object to processing of your personal data (e.g., if your personal data is inaccurate or unlawfully held).

  • Request transfer of your personal data.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

This website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements.

  1. ANONYMOUS DATA FROM GOOGLE ANALYTICS

Google, and other third party vendors, use cookies to serve ads to our users based on their visit to our site and other sites on the Internet. Users may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy.

We are committed to ensuring that our website contains content that is valuable and useful to our readers. To help us with this we have implemented the Google analytics demographics and interest reporting features on our website. These tools allow us to review anonymous data regarding the gender, age and interests of website visitors and adapt our website content to better reflect their needs.

Although this information is collected through your Google ad settings, it is not provided to us in a personally-identifiable format. This means we cannot identify what information is about you, and we will not try to figure it out.

ERA may use software programs to create summary statistics, which are used for such purposes as assessing the number of visitors to the different sections of our site, what information is of most and least interest, determining technical design specifications, and identifying system performance or problem areas.

For site security purposes and to ensure that this service remains available to all users, ERA uses software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage.

CAN-SPAM Compliance

In compliance with the CAN-SPAM Act, all e-mail sent from our organization will clearly state who the e-mail is from and provide clear information on how to contact the sender.
